Rental agreement

GENERAL RENTAL TERMS AND CONDITIONS

The following clauses govern the mutual rights and obligations of the parties and constitute an essential condition of the agreement, without which Camera Rental Pro would not enter into the contract.


Rented Equipment and Accessories

All rented equipment and accessories covered by this agreement are the exclusive property of Camera Rental Pro.


Operation of the Equipment

Camera Rental Pro does not provide the lessee with instructions, training, or guidance regarding the operation or use of the rented equipment.


Delivery and Return of Equipment

The lessor delivers the rented equipment to the lessee in perfect working condition and in accordance with the agreed inventory. The lessee undertakes to return the equipment in the same condition on the agreed return date and time.


Defects or Damage Upon Return

In cases where damage or loss is not covered by insurance, the lessee shall be required to pay the full replacement value of the equipment as new, at prevailing market prices, within 15 calendar days of the agreed return date.


Late Return of Equipment

Any delay in returning the rented equipment that has not been expressly authorized in writing by Camera Rental Pro shall be charged at the rate of one additional rental day for every 24 hours of delay, without any applicable discounts.

If the delay exceeds 72 hours, Camera Rental Pro reserves the right, in addition to charging the corresponding fees, to immediately initiate appropriate legal action.


Equipment Breakdown During the Rental Period

Camera Rental Pro assumes no responsibility for equipment replacement resulting from misuse. Where replacement is authorized, it shall be subject to equipment availability.


Modifications to the Equipment

The lessee shall not modify, disassemble, repair, sell, pledge, or otherwise dispose of the rented equipment or its accessories. Any such actions shall give rise to full legal responsibility on the part of the lessee.


Liability for Damage to the Equipment

Any damage caused to the equipment as a result of misuse shall be the sole responsibility of the lessee.


Civil Liability for Damage to Third Parties

The lessee shall be fully liable for any damage caused to third parties as a result of misuse of the equipment. Camera Rental Pro expressly disclaims any responsibility for accidents or damages arising from the use of the rented material.


Use of Equipment Outside the Country

The lessee must notify Camera Rental Pro, either at the time of contract execution or thereafter, of any intention to take the equipment outside the country during the rental period. All arrangements and legal requirements related to international transport shall be the sole responsibility of the lessee.


Liability Under Data Protection Law

Any liability arising from actions carried out under Organic Law 15/1999 of December 13 on the Protection of Personal Data, including those resulting from recordings made or loss of data, shall not be attributable to Camera Rental Pro. The lessee shall be fully responsible for any claims arising from such actions.


Express Submission to the Courts of Barcelona

Any dispute relating to the interpretation or enforcement of these terms shall fall under the exclusive jurisdiction of the Courts of Barcelona. The lessee expressly waives any other jurisdiction that may otherwise apply.


INSURANCE COVERAGE

The rented equipment is insured during transport between any two points within Europe, as well as during stays in Albania, Azerbaijan, Bosnia and Herzegovina, North Macedonia, the Chechen Republic, Serbia and Montenegro, Shida Kartli (South Ossetia), Russia, Tajikistan, and Turkey.

Coverage includes periods prior to transport, during assembly, filming, and post-transport stays while the equipment is in use. Extensions of coverage for specific countries may be assessed on a case-by-case basis.

All journeys made by land, sea, river, lake, or any combination thereof—whether by conventional or non-conventional means—are insured.

The rented audiovisual equipment is insured against all risks of loss, damage, and related expenses resulting from vehicle accidents. Coverage also includes theft, fire, breakage, water damage, and has been expressly extended to include lens breakage.

The risk of theft is covered during short-term parking on public roads, provided that the insured items are not visible from outside the vehicle, the vehicle is properly locked, and access is gained through forced entry (including doors, locks, or windows).

When insured equipment remains overnight inside vehicles parked in garages, parking lots, or other enclosed spaces, it must be adequately supervised. In the event of an incident, it must be reported immediately to the nearest police station.

The following are expressly excluded from coverage: damage due to normal use, incompetence, negligence, electrical or magnetic causes, scratches or scuffs, software damage, latent defects, theft by fraud or misappropriation, and damage caused by biological or chemical contamination. In such cases, the lessee shall bear the full cost of repair or replacement with new equipment, payable within 15 days of the agreed return date.

The insurance policy includes a deductible of €150, payable by the lessee.
